1. Agreement to Terms

By accessing or using the services of Paul Ferreira's Racing Engines ("Paul Ferreira Racing Engines," "we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services or website. These Terms apply to all visitors, users, and others who access or use our services.

2. Services Description

Paul Ferreira's Racing Engines provides precision racing engine machining, assembly, and related machine shop services from our shop in Fort Myers, FL. Our services include but are not limited to:

  • Complete engine builds
  • Engine refresh and program updates
  • Cylinder honing
  • Line honing
  • Block resurfacing
  • Cylinder head resurfacing
  • Cylinder head porting
  • High performance valve jobs
  • Related inspection, measurement, and project support as agreed for each job

3. Professional Standards

We perform machining and assembly work to professional racing and machine shop standards appropriate to the scope of each project. Specific build requirements, clearances, materials, and acceptance criteria are defined in your written quote, work order, or project contract.

4. Quotes and Estimates

Estimates and quotes provided by Paul Ferreira's Racing Engines are based on the information available at the time of assessment. Final costs may vary based on:

  • Additional wear, damage, or conditions discovered during teardown or inspection
  • Changes to the scope of work requested by the client
  • Parts price fluctuations or product availability
  • Unforeseen machining, machining corrections, or related complications

All quotes are valid for 30 days unless otherwise specified. Acceptance of a quote constitutes agreement to these Terms and any project-specific terms outlined in the contract or written work agreement.

5. Contracts and Payments

Payment Terms

Payment terms are specified in your project contract, invoice, or written agreement. Payment is due according to the schedule outlined for your job unless otherwise agreed in writing. Accepted payment methods will be confirmed with you before work begins or parts are ordered.

Florida Law

Contracts and commercial dealings related to our services are subject to applicable Florida law. Clients will receive any notices and disclosures required for the specific engagement as set out in the written agreement for the project.

6. Project Timeline

Project timelines are estimates based on typical conditions. Actual completion dates may be affected by parts availability, client-requested changes, machine shop scheduling, inspection findings, or other unforeseen conditions. We will make reasonable efforts to complete projects within estimated timeframes and will communicate material delays promptly.

7. Parts, Shipping, and Access

Unless otherwise specified in the contract, the client is responsible for providing engines, components, and related parts as agreed, and for arranging delivery to and pickup from our shop at 12220 ITEC Haul Dr Ste 227, Fort Myers, FL 33913. Shipping, freight, insurance in transit, and related logistics are the client's responsibility unless we expressly agree otherwise in writing. The client is responsible for ensuring we have clear instructions and timely decisions needed to proceed with the work.

8. Warranties and Guarantees

Warranty coverage for workmanship and materials varies by project and product and is governed by your signed contract and any manufacturer warranties that apply. In general:

  • Workmanship warranty: As specified in your contract and warranty materials
  • Material and parts warranties: Per manufacturer specifications, where applicable

Warranties typically do not cover damage resulting from misuse, neglect, improper installation or tuning by others, racing abuse outside the intended application, accidents, natural disasters, improper maintenance, or unauthorized modifications. Warranty claims must be submitted in writing within the applicable warranty period. Specific coverage details are addressed in your project contract.

9. Client Responsibilities

Clients agree to:

  • Provide accurate information about the engine, application, class, and performance goals
  • Deliver and pick up engines and parts as scheduled, or arrange shipping as agreed
  • Make timely decisions on parts selections, clearances, and approvals
  • Maintain clear communication channels
  • Provide timely payments per contract terms
  • Follow break-in, maintenance, and operating guidance provided for the completed work

10. Changes and Cancellations

Change Orders

Any changes to the original scope of work must be documented in a written change order or updated work authorization signed or otherwise confirmed by both parties. Change orders may affect project timeline and cost.

Cancellation Policy

Cancellation terms are specified in individual contracts. Generally, deposits are non-refundable after work has commenced or parts have been ordered. Clients are responsible for payment of all work completed and materials ordered or delivered prior to cancellation notice.

11. Limitation of Liability

To the fullest extent permitted by law, Paul Ferreira's Racing Engines's liability is limited to the total amount paid by the client for the specific project in question. We are not liable for indirect, incidental, consequential, or special damages, including lost races, lost prizes, downtime, or related expenses. This limitation applies to claims based on contract, warranty, negligence, or any other legal theory. Content on this website is provided for informational purposes and does not create project-specific obligations beyond your signed agreement.

12. Indemnification

Client agrees to indemnify and hold harmless Paul Ferreira's Racing Engines, its owners, employees, and agents from any claims, damages, or expenses arising from the client's use of our services, violation of these Terms, or infringement of any third-party rights, except to the extent caused by our gross negligence or willful misconduct as determined by a court of competent jurisdiction.

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Dispute Process

In the event of a dispute, the parties agree to:

  • First attempt to resolve the matter through good-faith negotiation
  • If negotiation fails, consider mediation before pursuing litigation
  • Resolve disputes in the appropriate courts of Florida

14. Shop Safety

Visitors to our shop must follow safety instructions and stay clear of active work areas, machinery, and hazardous materials. We reserve the right to refuse access to anyone who creates an unsafe condition.

15. Intellectual Property

All designs, text, images, videos, and materials on this website, and any documentation we create for marketing or general use, remain our intellectual property unless otherwise specified in writing. Unauthorized copying or redistribution is prohibited. We reserve the right to use photos and descriptions of completed projects for marketing purposes, subject to client approval where required by your contract.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.
